Shipping Policy

This policy covers physical Signature Xalam instruments and downloadable One Man Tribe sample products.

SIGNATURE XALAM — PRODUCTION AND SHIPPING

All Signature Xalam instruments are handmade to order in Senegal.

Production time is usually around 2 weeks.

Shipping time is usually around 2–4 weeks, depending on the destination country, customs processing and local delivery services.

We offer international shipping to selected countries with shipping calculated at checkout. A tracking number will be provided when available.

Production begins after payment has been successfully confirmed.

SHIPPING ADDRESS

Please make sure your shipping address and contact information are complete and correct before placing an order.

We are not responsible for delays, additional costs or failed deliveries caused by incomplete or incorrect address information supplied by the customer.

If you notice an address error after ordering, contact hello@benaylon.com immediately. We cannot guarantee that an address can be changed after production or shipping has begun.

CUSTOMS, DUTIES AND TAXES

Customs fees, import duties, tariffs, taxes and local charges may be applied by the destination country.

These charges are the customer’s responsibility and are not included in the product or shipping price.

We cannot control customs decisions, processing times or charges imposed by local authorities.

DELIVERY TIMES AND DELAYS

Shipping to the United States may take longer than usual because of customs processing, tariff-related procedures or changes in import regulations.

All production and delivery times are estimates rather than guaranteed delivery dates.

Delivery may be delayed by customs, tariffs, weather, public holidays, courier delays, regulatory changes, local postal conditions or other circumstances outside our reasonable control.

TRACKING AND DELIVERY ISSUES

When tracking is available, the tracking information will be sent to the email address supplied with the order.

Customers are responsible for monitoring the shipment and responding to delivery or customs requests from the carrier or local authorities.

If your tracking information shows an unusual delay, or if the instrument arrives damaged, contact hello@benaylon.com with your order number and the relevant tracking information.

ONE MAN TRIBE DIGITAL SAMPLE PRODUCTS

Digital sample packs and bundles are not physically shipped and have no shipping charge.

After Shopify confirms payment, secure download links are sent to the email address supplied at checkout through Shopify’s digital-delivery service.

Please provide a working email address and check your inbox, spam and promotions folders.

If the download email does not arrive or a download link does not work, contact hello@benaylon.com with your order number and the product name so that access can be restored.

ORDERS CONTAINING BOTH PRODUCT TYPES

If an order contains a Signature Xalam and digital sample products, the sample files are delivered electronically after payment is confirmed.

The Signature Xalam will follow the separate production and physical-shipping timeline described above.

Refund Policy

This store sells two different product types. The rules below apply according to the product purchased. Nothing in this policy limits rights that cannot lawfully be excluded under applicable consumer law.

HANDMADE SIGNATURE XALAM INSTRUMENTS

Each xalam is handmade to order in Senegal. Because the instrument is made specifically for each customer, we do not accept cancellations or refunds once production has started, except where required by law.

If you need to cancel a xalam order, contact hello@benaylon.com as soon as possible. If production has not started, we may be able to cancel and refund the order.

If an instrument arrives damaged or there is a clear issue with the order, contact us within 7 days of delivery. Include your order number and clear photographs of the package and instrument. We will review the case and work with you toward a repair, replacement, return or refund, as appropriate.

Any approved return must be unused and in its original condition. Return shipping is the customer’s responsibility unless the issue was caused by our mistake or applicable law requires otherwise.

Customs fees, import duties, taxes and local delivery charges are not refundable by us.

ONE MAN TRIBE DIGITAL SAMPLE PRODUCTS

Sample packs and bundles are digital downloads delivered after payment. Because digital files can be accessed and copied immediately, digital purchases are generally final once download access has been supplied or used.

Exceptions may apply when:

• The files are defective or corrupted.
• The wrong product was delivered.
• A duplicate charge occurred.
• We cannot restore access to a valid purchase.
• Applicable law requires another remedy.

If you do not receive your download email, cannot access the files, or believe there is an order or file error, contact hello@benaylon.com with your order number and the product name.

We will first attempt to restore access, resend the files, replace a defective file or correct the order. If that does not resolve a qualifying issue, we will consider an appropriate refund.

Please review the product format and contents before purchasing. A change of mind after downloading, failure to use the files, or dissatisfaction unrelated to a technical or delivery problem does not normally qualify for a refund, subject always to mandatory legal rights.

Terms of Service

By placing an order through this PayPal checkout, you agree to these Terms of Service and to the policies and licence applicable to the products you purchase.

This storefront serves the Signature Xalam storefront and the One Man Tribe Samples storefront. All products are sold by Ben Aylon.

PRICES, PAYMENT AND ORDERS

Prices are listed in USD unless the checkout displays another currency.

We may update prices, product descriptions, availability and promotions before an order is placed.

An order is accepted after payment has been successfully confirmed. We may contact you or cancel an order if:

• Required information is incomplete or inaccurate.

• A product is unavailable.

• Payment cannot be confirmed.

• An obvious pricing, product-information or technical error occurred.

• We reasonably suspect fraud, unauthorised activity or misuse of the store.

SIGNATURE XALAM INSTRUMENTS

Each Signature Xalam is handmade to order in Senegal through the collaboration of Ben Aylon and master luthier Abdoulaye Traoré Diop and the workshop in Dakar.

Natural differences in wood, skin, colour, shape, finish and sound are part of the instrument’s handmade character. Product photographs are representative, and every instrument may vary slightly.

Production and shipping estimates are provided as guidance and are not guaranteed delivery dates.

Customers must provide accurate contact and shipping information. Customers are responsible for customs fees, import duties, tariffs, taxes and local charges imposed by the destination country.

We are not responsible for delays caused by customs, courier services, incorrect addresses, local postal services, weather, regulatory changes or other events outside our reasonable control.

ONE MAN TRIBE DIGITAL SAMPLE PRODUCTS

After payment, digital sample files are delivered through secure download links.

The sounds are licensed, not sold. Purchasing a sample product grants the purchaser a non-exclusive licence to use the sounds in accordance with the full One Man Tribe Sample Licence and Terms:

Purchasing a sample product does not transfer copyright or ownership of the original recordings.

Under the standard licence, the sounds are 100% royalty-free for use in original music, including commercial releases, except for the paid-clearance situations defined in the full Sample Licence.

Paid written clearance is required for:

• Major-label releases after the applicable track exceeds four million combined worldwide streams.

• Feature films and the professional company productions defined in the full Sample Licence.

Any fees, royalties, publishing splits, credits or other conditions connected to these exceptions will be negotiated individually. The complete Sample Licence controls the definitions, conditions and clearance requirements.

Customers may not:

• Resell, share, sublicense, upload or distribute the original sample files.

• Distribute modified samples as standalone audio files.

• Use the samples to create another sample pack, sound library or competing sample product.

• Share download links, access credentials or purchased files with another person.

• Claim ownership of or register copyright in the original sample recordings.

The files may be used only as permitted by the Sample Licence. Product-specific credits and rightsholder information remain applicable where stated.

DIGITAL DELIVERY

Customers are responsible for providing a working email address and maintaining access to it.

If a download email does not arrive or a link does not work, contact hello@benaylon.com with the order number and product name so that access can be restored.

INTELLECTUAL PROPERTY

All product photographs, videos and written content are © Ben Aylon unless otherwise credited.

The xalam is a traditional West African instrument. The Signature Xalam model presented by the store is built to order by the workshop in Dakar.

Website content, photographs, videos, artwork, branding, text and music-related materials may not be copied, reproduced or reused without permission, except where applicable law permits otherwise.

Original sample recordings remain the property of their respective rightsholders and may be used only under the licence supplied with the applicable product.

THIRD-PARTY SERVICES

Payments and checkout are processed through PayPal and the payment providers available at checkout.

Some services, including payment processing, shipping, email delivery, analytics and digital-file delivery, are provided by third parties and may also be governed by their respective terms and privacy policies.

CUSTOMER INFORMATION AND LEGAL RIGHTS

You agree to provide accurate payment, contact, shipping and delivery information.

Nothing in these Terms excludes or limits consumer rights or other legal rights that cannot lawfully be excluded.

The version of the applicable policy or licence displayed or supplied at the time of purchase governs that transaction.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply.

We may update these Terms when our products, services or legal obligations change. Updated Terms apply to orders placed after the revised version is published.

Ben Aylon operates this storefront and its connected storefronts, including benaylon.com, xalam.benaylon.com and samples.benaylon.com.

The store sells made-to-order Signature Xalam instruments and downloadable One Man Tribe sample products. PayPal powers the checkout and helps us provide these services.

This Privacy Policy explains how we collect, use and disclose personal information when you visit a connected storefront, make a purchase, use our services or otherwise communicate with us.

PERSONAL INFORMATION WE COLLECT OR PROCESS

We do not sell personal information for money. Certain advertising or analytics disclosures may be legally considered a “sale,” “sharing” or use for targeted advertising in some jurisdictions. Where applicable, you may exercise the relevant opt-out rights through the cookie-preference controls or by contacting us.

RELATIONSHIP WITH SHOPIFY

The shared store and checkout are hosted by PayPal. PayPal collects and processes personal information about access to and use of the store to provide and improve its services.

Information submitted through the store may be transmitted to PayPal and relevant service providers, including parties located in countries other than the country where you live.

COOKIES AND SIMILAR TECHNOLOGIES

The connected storefronts and PayPal checkout use cookies and similar technologies to operate the store, understand traffic and measure advertising.

These technologies fall into three categories:

• Necessary technologies — required for security, cart operation, checkout, payment processing, order management, fraud prevention and saving your privacy choices. These technologies cannot generally be disabled through our cookie settings.

• Analytics technologies — including Google Analytics and, where enabled, EU-hosted PostHog. These technologies help us understand website usage, product interactions, cart activity, checkout activity, purchases, device information, approximate location and referral sources.

• Marketing technologies — including the Meta Pixel, Meta Advanced Matching and Meta Conversions API. These technologies help us measure advertising performance, product views, cart activity, checkout activity and purchases and may support attribution, audience measurement and relevant advertising.

GOOGLE ANALYTICS

We use Google Analytics to understand how visitors use our connected storefronts and PayPal checkout.

Google Analytics may process information about pages and products viewed, cart and checkout activity, purchases, approximate location, device and browser information, referral sources and campaign interactions.

Google Analytics measures this storefront and clicks leading to PayPal. A visit to the return page does not verify a completed purchase. Google processes this information according to its own privacy policies.

META PIXEL

We use the Meta Pixel on this storefront for advertising measurement and attribution, only after marketing consent. PayPal handles checkout independently.

YOUR COOKIE AND TRACKING CHOICES

Where consent is required, optional analytics and marketing technologies are used only after consent.

The available controls may allow you to:

• Accept all optional technologies.

• Reject optional technologies.

• Manage Analytics and Marketing separately.

Necessary technologies remain active because they are required for the storefronts, cart and checkout to operate.

Your selection may be stored in your browser so that you are not asked again on every page. You can change or withdraw your choices through the Cookie Settings or Manage Preferences control available on the relevant storefront.

Changing or withdrawing consent prevents future optional processing through those controls but does not affect processing that occurred before the change.

You can unsubscribe at any time using the unsubscribe link included in the email.

If you unsubscribe, we may still send non-promotional communications concerning orders, payments, production, shipping, digital delivery or customer support.

The connected storefronts and checkout may contain links to third-party websites or platforms.

We are not responsible for the privacy practices, security or content of those third-party services. If you follow an external link, you should review that service’s privacy policy and terms.

The store is not intended for children. We do not knowingly collect personal information from children under the age of majority in their jurisdiction.

If you believe a child has provided personal information, contact us and we will take appropriate steps to delete it where required.
